PROMOTION PROMISED FOR 3 YEARS. NEVER GIVEN. FORCED TO RESIGN. — RETAIL COMPANY, FARIDABAD

Promotion Promised for 3 Years. Never Given. Forced to Resign. — Retail company, Faridabad

The Client: A 38-year-old female Manager at a Retail House in Faridabad with 6 years of service. She was the only woman in a 19-member branch leadership team.

What Happened: Every year for three years, her Vice President promised her a promotion to Branch Head — "next year for sure." But every year, male colleagues with equal or lower performance got promoted instead of her. When she finally complained to HR through email, things got worse. The VP took away her important accounts and gave them to junior staff. She was removed from client meetings she had always attended. Within two months, the workplace became so difficult that she had no choice but to resign. The company called it a voluntary resignation and refused to pay any compensation.

What the Evidence we collected from employee:

  • We collected her excellent rating records from the last three straight years and found that the moment she complained to HR, her rating suddenly dropped to "Needs Improvement" — in the very same quarter.
  • We collected a copy of the email sent by the employee to HR, requesting clarification on why she was being passed over for promotion year after year. HR never responded.
  • Internal promotion records showing that 4 male colleagues with equal or lower ratings were promoted during the same 3-year period
  • Calendar records showing she was removed from 12 client meetings in the 2 months after her HR complaint — meetings she had attended regularly for 5 years
  • WhatsApp messages from the vice president to her saying "you should look for opportunities elsewhere if you're not happy" — sent just 3 weeks after her HR complaint
  • Her resignation letter itself, which clearly stated: "I am being forced to resign due to a hostile work environment created after I raised concerns about unfair promotion practices"

How SPJ Advocates Helped:

  • We explained to employee that even though she resigned, it wasn't really voluntary — the company's hostile behaviour left her no choice. In Indian law, this is called constructive dismissal, and it's treated the same as being wrongful termination.
  • Sent a legal notice to the Retail Company demanding compensation for constructive dismissal, 3 years of denied promotions, retaliation, and hostile work environment
  • Filed a complaint with the Labour Commissioner and civil court highlighting the pattern of gender-based discrimination in promotions
  • Presented the complete evidence — 3 years of ratings, promotion records of fellow male members, the timing of the sudden poor rating, the removed meetings, and the Vice president's WhatsApp message
  • We argued that the company ignored her official complaint to HR and then immediately made her work life difficult — which is exactly what the law calls "constructive dismissal" (forcing someone to quit by making the workplace unbearable).
  • Negotiated aggressively for a comprehensive settlement

The Result: The Retail company settled out of court within 4 months. The employee received compensation equivalent to 14 months' salary — covering the denied promotions, notice period, constructive dismissal damages, and earned leave. The total settlement was approximately Rs. 12.5 lakh. The company also issued a clean relieving letter with her correct designation and positive service record.
