What Was the Case
Without any prior discussion or mediation attempt, the wife's family filed an FIR under Section 498A (cruelty by husband and in-laws) and Section 304B (dowry death attempt) of the IPC at a police station in Saket, New Delhi. The FIR named not just our client, but also his 65-year-old mother, his married brother living in Dubai, and his 70-year-old father who was recovering from heart surgery.
The FIR alleged that the husband's family had demanded ₹1 Crore in dowry, a car, and gold jewellery — and that when these demands were not met, the husband and his family physically and mentally harassed the wife. The FIR also alleged that the husband had tried to kill the wife by pushing her down the stairs.

- The Sessions Judge heard our arguments and reviewed the evidence
- The judge noted that the FIR was filed 4 months after the wife left, and that no medical report was filed for the alleged "pushing down the stairs" incident
