NRI Wanted to Buy Property Without His Physical Presence. We Handled Everything — From Verification to Registration

About the Client

A 48-year-old Indian-origin software engineer living in Toronto, Canada, for the past 15 years. He wanted to buy a 3BHK apartment in a RERA-registered project on Dwarka Expressway, Gurgaon, as an investment. The flat was priced at ₹5.4 crore.

What Was the Problem

The client was 12,000 km away and couldn't come to India for every property purchasing process. He had found the property online, spoken to the builder on video call, and was ready to pay. But he had several concerns: he couldn't visit the site in person, didn't know if the builder had all approvals, couldn't go to the Sub-Registrar for registration, and didn't know the NRI property purchase rules.

He had been cheated once before — 8 years ago, he paid ₹10 lakh to a Noida builder who disappeared. He never recovered the money. This time, he wanted everything checked before paying a single rupee.

How SPJ Advocates Handled It

Phase 1 — Property Verification

  • Visited the project site and verified construction was actually happening
  • Conducted a full title search and confirmed clear ownership with no disputes
  • Verified RERA registration, building plan, environmental clearance, fire NOC
  • Checked the builder's track record and any RERA complaints
  • Submitted a detailed Property Verification Report: SAFE TO PROCEED

Phase 2 — Agreement Review and Negotiation

  • Reviewed the builder-buyer agreement clause by clause — found 6 unfair clauses
  • Negotiated changes to 4 clauses including a possession delay penalty and clear refund policy
  • Builder agreed to changes within a week after we cited RERA provisions

Phase 3 — NRI Compliance

  • Advised on NRI purchase rules under FEMA
  • Confirmed payment must come from NRE or NRO account — not Canadian bank
  • Helped him open an NRO account through an online process

Phase 4 — Power of Attorney and Registration

  • Drafted a Special Power of Attorney authorizing a family member to sign the sale deed
  • SPA was executed at the Indian Consulate in Toronto, apostilled, and couriered to India
  • We accompanied the family member to the Sub-Registrar on registration day
  • Sale deed registered, stamp duty paid, property transferred — all without the client flying to India

Phase 5 — Post-Registration

  • Got mutation done at the Municipal Corporation of Gurgaon
  • Registered property tax in the client's name
  • Advised on capital gains tax implications for future sale
  • Set up a simple property management checklist for the family member

The Result

We completed the entire process of verification to registered ownership was completed in 60 days. The client was never present to India.

He told us on a video call: "Last time I trusted a builder and lost ₹12 lakh. This time I trusted a lawyer and got a property. The ₹50,000 I paid SPJ was the best investment I made — it saved me from making another mistake."

He has since referred two NRI colleagues in Canada to SPJ Advocates for property purchases in Delhi NCR.
