About the Client
A 32-year-old working professional in Noida who had booked a 2BHK flat on SPR Road, Sector 70, Gurugram, for ₹80lakh. The builder had sent a possession letter asking her to pay the final ₹8 lakh and collect the keys. She had already paid ₹72 lakh over 3 years.
What Was the Client's Requirement
Before paying the final amount and taking possession, she wanted SPJ Advocates to verify that the flat was legally safe to move into — that all building approvals were in place.
What Our Verification Found following problems:
- No Occupation Certificate: The builder was handing over possession without an OC from the Gurugram Authority. Without it, the flat was technically not legal to occupy.
- Extra Floors Built Without Approval: The building had 14 floors, but the approved plan was for only 12. The top two floors were built without permission.
- Society Not Registered: The builder still controlled maintenance funds, common areas, parking, and club house.
- Temporary Electricity and Water: The entire building was running on temporary connections meant for the construction phase only.
How We Helped Her After the Report
- We sent a legal notice to the builder demanding OC, society registration, and permanent utility connections
- Filed a complaint with HRERA on behalf of our client and 15 other buyers
- RERA Authority issued a notice to the builder with a 90-day compliance deadline
The Result
The builder obtained the OC within 4 months. The society was registered. Permanent utility connections were applied by the builder. Our client paid the final instalment only after all approvals were confirmed and moved into her home.
